Análisis del papel del Congreso de la República en la garantía del derecho a la reparación integral de las víctimas en el marco del posconflicto colombiano (2016-2022)

El Congreso colombiano desempeñó un papel crucial en el marco del posconflicto tras la firma del Acuerdo Final de Paz en 2016, implementando leyes destinadas a garantizar los derechos humanos de las víctimas y facilitar la reincorporación de excombatientes. Entre 2016 y 2022, el cuerpo legislativo promovió normativas clave, como la Ley de Víctimas y Restitución de Tierras, buscando reparar el daño causado por décadas de conflicto armado. Sin embargo, el análisis de su técnica legislativa y la eficacia de las disposiciones normativas revela desafíos significativos, incluyendo dificultades de implementación y escasa claridad jurídica. Este estudio analiza el impacto legislativo del Congreso en la consolidación del Estado Social de Derecho y la garantía de los derechos fundamentales en el contexto del posconflicto.
The Colombian Congress played a critical role in the post-conflict framework following the signing of the 2016 Final Peace Agreement, enacting laws aimed at guaranteeing human rights for victims and facilitating the reintegration of ex-combatants. Between 2016 and 2022, the legislative body introduced key regulations, such as the Victims and Land Restitution Law, to address the harm caused by decades of armed conflict. However, an analysis of its legislative techniques and the effectiveness of its normative provisions highlights significant challenges, including implementation difficulties and a lack of legal clarity. This study critically examines the legislative impact of Congress on consolidating the Social Rule of Law and ensuring fundamental rights in the post-conflict context.
